| Free DISH HDTV Terms and Conditions Offer Terms
PLEASE READ
For new, first-time DISH Network residential customers (only 1 per household). Offer is available in the continental United States between 10/18/03 and 1/31/04. All prices, packages and programming subject to change without notice. Local and state sales taxes may apply. Offer requires a Social Security Number and valid major credit card. Participation is subject to credit approval. Social Security Numbers are used to obtain credit scores and will not be released to third parties except for verification and collection purposes.
Upfront Fee
You agree to pay $49.99 plus an additional upgrade fee of $999 and at time of initial installation you will receive Free Standard Professional Installation of a DISH Network HDTV system. You will receive a $49.99 credit on your first bill.
Minimum Programming Purchase/Equipment Configurations
This offer requires the purchase of 12 consecutive months of Qualifying Programming (as defined below) to receive a satellite TV system with the following equipment: one DISH 811 receiver, one 34" HD monitor or one 40" HD monitor, and one DISH 500 antenna. Qualifying Programming includes America's Top 150 (currently $42.99/mo.), America's Top 100 (currently $33.99/mo.), America's Top 50 (currently $24.99/mo.), DISH Latino Max (currently $41.99/mo.), DISH Latino Dos (currently $31.99/mo.) or DISH Latino (currently $21.99/mo.) programming.
Equipment and Installation
Additional receivers must be activated in conjunction with a primary receiver, and are subject to a $4.99 per month programming access fee per receiver. For this offer, Standard Professional Installation includes installation of one 20" dish antenna (or one SuperDISH antenna if applicable), hook-up of one receiver to one TV and equipment testing, available through DISH Network Service Corporation. Other installation restrictions apply and more complex installations may require additional fees. MSRP for Standard Professional Installation is $199. MSRP for each additional receiver installation is $59.
Early Termination
If service is terminated or downgraded below Qualifying Programming prior to 12 months, a cancellation fee of $240 will apply. Cancellation fees are in addition to any other charges or fees that may apply, if any.
Value Pak Programming Credits
If you activate and subscribe to the DISH Network Value Pak with America's Top 100, America's Top 150, DISH Latino Dos or DISH Latino Max or to America's "Everything" Pak ("Minimum Value Pak Programming"), you will receive a $49.99 programming credit for the 2nd, 3rd and 4th month of service. You will forfeit any remaining credits in the case of a downgrade from the Minimum Value Pak Programming or service disconnection before the 4th month of service. After the initial three months from date of activation of the Value Pak, your selected programming package will continue to be billed at then current price unless you downgrade to a minimum of America's Top 50 or DISH Latino programming.
Fees and Credit Card Charges
By placing this order, you agree that any applicable cancellation fee will automatically be charged to your DISH Network account or your credit card provided to DISH Network. You authorize DISH Network to investigate your creditworthiness. You further authorize DISH Network to report any payment defaults to credit reporting agencies. You acknowledge and agree that DISH Network is not extending credit and that the cancellation fee is not interest, a credit service fee or a finance charge
Service Fees
There is a monthly DISH Video-On-Demand Service fee for each DISH Player-DVR 510 receiver, based on the monthly programming subscription as follows: America's Top 50, DISH Latino, America's Top 100, DISH Latino Dos, America's Top 150 or DISH Latino Max - $4.98; America's "Everything" Pak - no charge. If at any time you do not subscribe to DISH Latino, DISH Latino Dos, DISH Latino Max, America's Top 50, America's Top 100 or America's Top 150 programming, a $5.00 per month Service Access Fee will apply and a $4.98 per month DISH Video-On-Demand Service fee will apply if applicable (in addition to any cancellation or other applicable fees). There is a $5.00 Change of Service Fee for each programming downgrade or change to same level of programming (the $5.00 fee will be waived for customers participating in 3 Months Free if programming is downgraded within 30 days of 3rd free month) and a $10.00 Change of Service Fee for each Adult programming downgrade or change to same level of programming.
Programming
Local Channels packages by satellite are only available to customers who reside in the specified local Designated Market Area (DMA). Certain local channels may require an additional dish antenna from DISH Network, installed free of any charges. SuperDISH antenna may be required to receive local channels and will be included at no additional charge with subscription to local channels for 12 consecutive months. If service is downgraded, a termination fee equal to the monthly charge of local programming multiplied by the number of months remaining will apply. Distant Networks packages by satellite are only available for private home viewing and in limited areas, to homes that are located outside a Grade A or B designated area or with the approval of local affiliates. Local Channels and/or Distant Networks packages are available at an additional charge (up to $5.99 per month) for those who qualify. ESPN and ESPN2 programming subject to change and blackout restrictions, and are licensed separately for residential and commercial use. Some games telecast locally may also be included in ESPN packages. FOX Sports Networks programming subject to blackout restrictions, and is licensed for residential use only. Regional sports networks and Turner South not available in all areas. All payments for programming are non-refundable.
Other Terms and Conditions
DISH Network shall determine eligibility for this offer in its sole and absolute discretion. Programming and other services provided are subject to the terms and conditions of the promotional agreement and Residential Customer Agreement, which is available at the link below for "Residential Agreement."
